These Terms of Service (“Terms”) govern access to and use of the Datalysis platform (the “Platform”) and the services offered through it (the “Services”), operated by KWS Group S.A. de C.V.

By accessing, browsing, or using Datalysis, the user expressly agrees to these Terms.

Datalysis is a Business Intelligence, Data Analytics, Automation, and Artificial Intelligence platform primarily designed for companies (B2B) and entrepreneurs.

2. Scope of Services

Datalysis offers, among others:

  • Access to a SaaS platform for data visualization, analytics, and automation
  • Customized dashboards and reports
  • Data integration from external systems (ERP, CRM, POS, among others)
  • AI-powered analytics tools and business insights
  • Professional services such as consulting, data architecture, and custom development

The specific scope of each service will be defined through commercial proposals, quotations, contracts, or equivalent documents.

3. User Accounts and Access

Access to the Platform requires the creation of an account associated with a corporate email address.

Each user is responsible for maintaining the confidentiality of their credentials.

The client is responsible for all actions carried out through accounts associated with its organization.

Datalysis may suspend or restrict access in cases of misuse, security risks, or breach of these Terms.

4. Pricing, Subscriptions, and Implementation

Use of the Platform may be subject to subscription plans, with pricing and conditions communicated in advance to the client.

Implementation, integration, customization, or consulting services involve additional costs, defined through a specific quotation for each client.

Pricing may vary depending on project scope, complexity, and requirements.

Failure to pay for contracted services may result in suspension of access to the Platform.

5. Data Ownership and Use

5.1 Client Data from External Systems

When data originates from the client’s systems (ERP, CRM, POS, or others), ownership of such data remains exclusively with the client.

Datalysis acts solely as a data processor and visualization provider.

5.2 Data Registered Directly in Datalysis

Data created, recorded, or managed directly within the Datalysis Platform—when not originating from external systems—may be considered property of Datalysis, without prejudice to the client’s right to use it during the term of the service.

5.3 Dashboards, Models, and Developments

Dashboard structures, analytical models, automations, and developments created by Datalysis constitute the intellectual property of KWS Group S.A. de C.V., granting the client a usage license for the duration of the contractual relationship.

6. Artificial Intelligence and Automation

Artificial Intelligence functionalities, including the assistant Daisy, are designed to support decision-making. Recommendations generated do not replace human judgment or professional advice. The client remains responsible for validating and deciding how to use generated information.

Datalysis does not train public AI models using confidential client data.

7. Confidentiality

Datalysis commits to maintaining the confidentiality of client information and using it solely for the provision of Services, in accordance with industry best practices for security and confidentiality.

Response times and service levels may vary depending on the contracted plan.

9. Limitation of Liability

Datalysis shall not be liable for:

  • Decisions made by the client based on information displayed
  • Interruptions caused by third parties or external providers
  • Indirect losses, lost profits, or consequential damages

10. Service Termination

Datalysis may suspend or terminate access to the Platform in case of breach of these Terms or operational reasons, notifying the client when reasonably possible.

11. Governing Law

These Terms are governed by the laws of the Republic of El Salvador, without prejudice to servicing international clients under specific agreements.
